Agreeing to these terms

These Terms of Service are an agreement between you and Birds Galaxy ("we", "us"). By creating an account or using the Birds Galaxy app or website, you agree to these terms, our Privacy Policy, Community Guidelines and Marketplace Policy. If you do not agree, please do not use Birds Galaxy.

Who can use Birds Galaxy

• You must be at least 13 years old.
• If you are under the age of adulthood where you live, you need permission from a parent or guardian.
• You may not use Birds Galaxy if we have previously removed your account for breaking these terms.

Your account

• Give accurate information when you sign up and keep it up to date.
• Keep your password safe. You are responsible for activity on your account.
• Do not create accounts pretending to be someone else, and do not sell or transfer your account.
• Tell us straight away if you think someone else is using your account.

Your content

You own the photos, videos, text and other content you post. By posting it, you give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute it within Birds Galaxy and to promote Birds Galaxy, for example by showing a public post on our website or social media. This licence ends when you delete the content or your account, except where others have already shared it or where we must keep it for legal reasons.

You confirm that you have the right to post your content and that it does not break anyone else's rights. See our Copyright Policy.

Rules of use

When using Birds Galaxy, you agree not to:

• Break the law, or break our Community Guidelines.
• Harass, threaten, bully or impersonate anyone.
• Post content showing cruelty to animals, or sell or promote the illegal trade of birds.
• Scam other users, or post fake listings, fake reviews or misleading information.
• Send spam, or use bots, scrapers or automated tools on the service.
• Try to hack, overload or interfere with the app, or get around our safety features.

Marketplace

The marketplace helps buyers and sellers find each other. Birds Galaxy is not a party to any sale. We do not handle payments, delivery or the birds themselves, and we do not guarantee the health, species, mutation, age or sex of any bird listed. Buyers and sellers are fully responsible for their own deals and for following all laws that apply, including wildlife and animal-welfare laws. More details are in our Marketplace Policy.

Care information and calculators

The Genetic Calculator, care guides and Bird Care Assistant are for general information only.

• Calculator results are predictions based on known genetics. Real chicks can differ, for example when a parent carries a hidden (split) gene you don't know about.
• The Bird Care Assistant may use artificial intelligence to answer questions. AI answers can be wrong or incomplete.
• Nothing in Birds Galaxy replaces advice from a qualified avian veterinarian. If your bird is sick or injured, contact a vet.

Suspending or ending accounts

You can stop using Birds Galaxy and ask us to delete your account at any time (see the Data Deletion Policy). We may hide or remove content, limit features, or suspend or remove accounts that break these terms or put others at risk. Where it is reasonable, we will tell you why.

Disclaimers

Birds Galaxy is provided "as is" and "as available". We work hard to keep it running well, but we cannot promise it will always be available, error-free or secure. Content posted by users belongs to them and does not reflect our views, and we are not responsible for it.

Limitation of liability

To the fullest extent allowed by law, Birds Galaxy is not liable for any indirect or consequential loss, or for any loss arising from your dealings with other users, including marketplace sales, or from relying on calculator results or care information. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of your country. Any disputes will be handled by the courts of that country, unless the law where you live gives you the right to use your local courts.

Changes to these terms

We may update these terms. If the changes are important, we will tell you in the app or by email before they take effect. If you keep using Birds Galaxy after that, you accept the new terms.
